17(1) A proposal to form, dissolve, or alter the boundaries of a municipality may be initiated by:
(a) the Minister;
(b) the council of a municipality; or
(c) at least 30 per cent of the persons who would be or who are electors of the municipality or the area proposed to be formed, dissolved, or altered.
(2) A proposal under subsection (1) must be in writing and filed with the Yukon Municipal Board.
(3) A proposal must include

(a) a statement that the proposal is

(i) to form a municipality with the class, name, and boundaries set out, or

(ii) to dissolve a specified municipality, or

(iii) to alter the boundaries of any municipality;

(b) the reason for the proposal;

(c) the name of each nearby municipality and each nearby Yukon First Nation government that could be affected by the formation, dissolution, or alteration of boundaries of a municipality;

(d) the name of the representative of the petitioning electors if the proposal is initiated by persons who would be or who are electors of the municipality or area proposed to be formed, dissolved, or altered.

(4) A proposal under subsection (1)(c) must be accompanied by a petition signed by not less than 30 percent of the persons who are or would be eligible to be electors of the municipality or area proposed to be formed, dissolved or altered.

19(1) A person who objects to a proposal must file a written objection with the Yukon Municipal Board within 60 days after the second date of publication of the notice in a newspaper under subsection 18(2) or within 60 days of the last public notice being given by any other method under subsection 18(2) if the notice is not published in a newspaper.

(2) The Board shall hold a public hearing.

(3) The Board shall set a time and place to hold the public hearing within 30 days of the end of the 60 day objection period.

(4) The Board shall notify the proponent, all persons to whom the Board is required to give a copy of the proposal to under subsection 18(1), anyone who has filed an objection, and anyone else the Board considers should be notified, and the Board shall hold the hearing to consider the objection, allowing any affected person to appear at the hearing.

Orders of the Commissioner in Executive

22(1) The Commissioner in Executive Council, after considering the report of the Yukon Municipal Board, may order the formation, dissolution, or other alteration of boundaries in relation to any municipality or area affected by the order, as the proposal was originally proposed or with modifications.
