Citizen consultation

§ 69

(1) The purpose of the citizen consultation is to investigate the will of the members of the municipality to make future decisions concerning the municipality, in particular plans, as well as questions of implementation within the municipality's own sphere of influence. Charges, fees and tariffs, elections of municipal bodies, personnel matters as well as decisions concerning specific individuals cannot be the subject of a citizen consultation.

(1a) The question put to the vote shall be clearly formulated and put in such a way that it is answered either in the affirmative or in the negative or, if several options (alternatives) are to be decided upon, the chosen alternative can be designated and the will of the person entitled to vote is clearly discernible.

(2) Citizen consultations can be carried out for the entire municipal territory or, if their subject exclusively refers to individual parts of a municipality (localities), also only for these.

(3) A citizens' consultation shall be carried out if it is decided by the municipal representation or if it is ordered by the mayor.

Effect

§ 70

If the unconditional majority of the valid votes cast is "yes" or if such a majority has voted in favour of one of several possible decisions, the municipal council must deal with the subject of the citizens' consultation within three months in a public meeting. An authorization of the municipal council or a committee to do so is excluded.
