ARTICLE 23. These are prerogatives of the Guanajuato citizens:
VII. participate in processes of plebiscite and referendum, as well as the procedure of popular initiative laid down in this Constitution and in the corresponding law; and (..)

ARTICLE 34. For the creation of a new municipality, it will need the following requirements:
III. The citizens of the affected Municipality may request it as a result of a plebiscite called under the terms of the corresponding Law;

Article 30.- The plebiscite may be requested by:
III.-ten per cent of citizens readily on the nominal list of the affected municipality to request the creation of a new municipality.

Article 32.- The result of the plebiscite will be binding when voted:
III. for the creation of a new municipality, at least fifty percent of citizens registered on the nominal list of voters of the affected municipality, and of these more than seventy percent has issued his vote in the same direction.

ARTICLE 34. For the creation of a new municipality, will require the following requirements:
I that land area that is intended to be is not less than 150 square kilometers;
II. that the population who dwell in that area is greater than seventy thousand inhabitants;

IV. that the village chosen as municipal seat has a population that is not less than twenty thousand inhabitants;
V. That this village has municipal public services essential to its population; and,
VI. that economic and fiscal studies which practised, is evidence that the likely fiscal income will be sufficient to meet the costs of the Municipal Administration.
